Beacon Escapes — Vacation Rental Terms & Conditions

Welcome to Beacon Escapes. These Terms and Conditions (“Terms”) govern your reservation and stay at any property managed by Beacon Escapes (each, the “Property”).

By completing a reservation, you (“Primary Guest”) acknowledge that you have read, understood, and agreed to these Terms on behalf of yourself and all guests, visitors, and occupants in your party.


1. Parties & Definitions

  • “Beacon Escapes,” “we,” “us,” “our” refers to Beacon Escapes, the property management company.
  • “Property” refers to the vacation rental home or unit being rented.
  • “Primary Guest” is the person making the reservation and signing this agreement. The Primary Guest must be at least 25 years of age and must be physically present at the Property for the duration of the stay.
  • “Guest” or “Guests” refers to all individuals occupying or visiting the Property during the rental period, including invitees of the Primary Guest.
  • The Primary Guest is responsible for the conduct of all Guests and visitors and for ensuring all Guests understand and follow these Terms.

2. Reservation & Payment

Booking Confirmation

  • A reservation is not confirmed until: (1) full payment has been received, and (2) the Primary Guest has agreed to these Terms electronically.
  • Beacon Escapes reserves the right to cancel any reservation that does not comply with these requirements.

Payment Schedule

  • Full payment (100% of the total reservation amount) is due at the time of booking confirmation. Reservations are not confirmed until payment is received in full.
  • This applies to direct bookings through beaconescapes.com, Vrbo reservations, and any manually entered reservations.
  • Airbnb and other OTA bookings are subject to that platform’s payment terms and are governed by the respective channel, not by Beacon Escapes directly.
  • All direct payments are processed securely through GuestyPay (Stripe).

Fees

  • Cleaning Fee: $350 per stay
  • Beacon Shield Damage Waiver: $79 per stay (required; see Section 9)
  • Pet Fee: $150 per stay (for properties that allow pets; one-time, non-refundable)
  • Applicable Taxes: Alabama state sales tax (4%), Baldwin County lodging tax (2%), Orange Beach lodging tax (10%) — totaling 16% (rate subject to change per local authorities)

Pricing

  • Rates and availability are subject to change until the reservation is confirmed. Once confirmed, the dates and Property are guaranteed.

3. Cancellation Policy

  • Cancellations 7+ days before check-in: Full refund minus a $50 processing fee.
  • Cancellations within 7 days of check-in: Non-refundable, unless Beacon Escapes is able to re-rent the Property for the same dates. If re-rented, the Guest will receive a refund of recovered amounts less the $50 processing fee.
  • No-shows and early departures: Non-refundable.
  • Travel insurance is strongly recommended to protect against unforeseen cancellations, illness, weather, or other disruptions. Beacon Escapes does not sell or offer travel insurance directly; Guests may purchase coverage from any third-party provider of their choice (e.g., Allianz, Travel Guard, RentalGuardian).

4. Check-In & Check-Out

  • Check-In Time: 4:00 PM CDT
  • Check-Out Time: 10:00 AM CDT
  • Early check-in / late check-out is not guaranteed and may incur an additional fee. Requests must be approved in advance.
  • A unique smart-lock entry code will be provided 24-48 hours before check-in via email and/or SMS.
  • Late checkout without prior approval may result in a fee equal to one night’s rate.

5. Occupancy & Use

Maximum Occupancy

  • Maximum overnight occupancy at each Property is strictly limited and listed on the Property listing page and confirmed in the reservation. Exceeding this limit is grounds for immediate termination of the stay without refund.

Permitted Use

  • The Property is rented for vacation/transient use only. No commercial use, events, parties, weddings, photoshoots, or filming is permitted without prior written consent from Beacon Escapes.
  • The Primary Guest may not sublet, assign, or transfer the rental.

House Rules

  • No smoking of any kind inside the Property (cigarettes, vaping, marijuana, etc.). Outdoor smoking is permitted in designated areas only. Violation incurs a $500 cleaning fee.
  • Quiet hours: 10:00 PM – 8:00 AM CDT.
  • No illegal activity of any kind on the premises.
  • Compliance with the Orange Beach noise ordinance and all local laws is required.

6. Pets

  • Pets are permitted only at Properties designated as “pet-friendly” and only with advance approval and payment of the $150 pet fee.
  • Maximum 2 dogs per stay, each under 75 lbs (unless otherwise approved in writing).
  • Pets must be housebroken, non-aggressive, and up-to-date on vaccinations.
  • Pets are not permitted on furniture or beds. Damage caused by pets is the Guest’s responsibility and not covered by the Beacon Shield Damage Waiver.
  • Guests are required to clean up after their dog at all times — inside the Property, in the backyard, in the surrounding neighborhood, and on any walks. Pet waste must be bagged and disposed of in outdoor trash bins.
  • Failure to clean up after a pet will result in a $100 per-incident fee charged to the Primary Guest’s payment method on file.
  • Dogs are not permitted on Orange Beach public beaches per city ordinance. Violators are subject to city fines.

Service Animals

  • Service animals (as defined by Title III of the Americans with Disabilities Act) are always welcome at all Properties and are not subject to the pet fee or any pet-related restrictions (size, breed, or count limits).
  • A service animal is a dog that has been individually trained to perform a specific task directly related to a person’s disability (e.g., guiding a blind individual, alerting to seizures, retrieving items for someone with mobility limitations).
  • In accordance with the ADA, Beacon Escapes may ask only two questions to confirm service animal status: (1) Is the animal required because of a disability? and (2) What work or task has the animal been trained to perform? We will not request documentation, certification, registration, ID, or proof of training.
  • Emotional support animals, comfort animals, therapy animals, and companion animals are NOT service animals under the ADA and are subject to the standard pet fee, breed, size, and count restrictions.
  • Service animal owners are responsible for any damage caused by their animal and for keeping the animal under control at all times. A service animal that is out of control, not housebroken, or aggressive may be required to leave the Property.
  • Per Alabama law (Ala. Code § 3-1-7), misrepresenting a pet as a service animal is a criminal offense, and violators will be reported to local authorities. Guests who falsely claim service animal status will also be charged the full pet fee plus a $250 fraud penalty.

7. Guest Responsibilities & Care of Property

The Primary Guest agrees to: – Treat the Property with care and leave it in the condition in which it was received. – Report any damage, malfunction, or maintenance issue to Beacon Escapes promptly via the contact methods provided. – Follow all posted safety, pool, hot tub, grill, and beach rules. – Lock all doors and windows when leaving the Property. – Not move, remove, or rearrange furniture without permission. – Dispose of trash according to instructions provided at the Property.


8. Privacy & Security Disclosure

For the safety of our Guests and Property: – Exterior security cameras and/or doorbell cameras may be installed at the Property. These cameras record video only (no audio) and are positioned only in exterior or common-area locations (front entry, driveway, exterior). No cameras of any kind are installed in any interior bedroom, bathroom, or other private space. – Smart locks are installed at all exterior entry doors, and entry/exit timestamps may be logged for security purposes. – Smart WiFi networks are provided for Guest convenience. – Beacon Escapes does not monitor live camera feeds except in response to a specific safety concern, lockout, or reported issue.

By staying at the Property, you acknowledge and consent to these security measures.


9. Damage, Liability & Beacon Shield

Beacon Shield Damage Waiver

  • Each reservation includes a mandatory $79 Beacon Shield Damage Waiver, which covers up to $3,000 of accidental damage during the stay.
  • Beacon Shield does not cover: intentional damage, gross negligence, pet damage, smoking violations, theft, or damage from unauthorized guests/parties.
  • Damages exceeding $3,000 or not covered by Beacon Shield will be charged to the Primary Guest’s payment method on file.

Reporting Damage

  • The Primary Guest agrees to report any accidental damage to Beacon Escapes during the stay. Failure to report damage that is later discovered may result in loss of Beacon Shield coverage and the full cost being charged to the Guest.

Personal Property

  • Beacon Escapes is not responsible for loss, theft, or damage to Guests’ personal property, vehicles, or belongings.

10. Cleaning & Condition

  • The Property is professionally cleaned before each arrival. If the Property is not to your satisfaction upon arrival, please notify us within 2 hours of check-in for immediate remediation.
  • Guests are expected to leave the Property in a reasonably tidy condition before departure:
  • Dishes must be placed in the dishwasher and the dishwasher started before checkout.
  • Used towels must be placed in the bathtub or on the bathroom floor of each bathroom used (NOT left on beds, furniture, or in laundry baskets).
  • Trash must be bagged and placed in the designated outdoor trash bins.
  • Personal belongings must be removed from the Property. Beacon Escapes is not responsible for items left behind.
  • All windows and doors locked, lights off, thermostat returned to the posted setting.
  • Excessive cleaning required beyond standard turnover (e.g., stains, odors, biohazards, smoking residue) will incur additional charges starting at $250.

11. Disturbances & Termination of Stay

Beacon Escapes reserves the right to immediately terminate the rental and require all Guests to vacate the Property, without refund, if: – Maximum occupancy is exceeded. – Smoking, illegal drugs, or unauthorized parties/events occur on the premises. – Disruptive, dangerous, malicious, or abusive behavior occurs toward neighbors, Beacon Escapes staff, vendors, or community members. – Material misrepresentation was made at the time of booking. – These Terms are otherwise materially breached.

In such cases, the Guest forfeits all amounts paid and is responsible for any related damages, fees, or law enforcement costs.


12. Force Majeure / Property Unavailability

If the Property becomes uninhabitable due to circumstances beyond Beacon Escapes’ control (hurricane, mandatory evacuation, fire, flood, structural failure, utility outage, etc.), Beacon Escapes will, at its sole discretion, either: 1. Refund all amounts paid for the affected nights, or 2. Offer a comparable substitute Property of equal or greater value, or 3. Offer rebooking credit for a future stay.

Beacon Escapes is not liable for consequential damages, travel costs, or expenses incurred by the Guest as a result of such unavailability.


13. Assumption of Risk & Limitation of Liability

Assumption of Risk

  • The Primary Guest and all Guests use the Property and its amenities entirely at their own risk. This includes, but is not limited to: swimming pools, hot tubs, the Gulf of Mexico and adjacent beaches, private or deeded beach areas, lakes, ponds, grills, fire pits, decks, balconies, stairs, watercraft, kayaks, paddleboards, bicycles, beach chairs, umbrellas, and all other indoor or outdoor recreational equipment.
  • Swimming, wading, and water activities at the pool, beach, or any other body of water are undertaken at the Guest’s sole risk. No lifeguards are on duty. Guests are responsible for their own safety and the safety of any minors or non-swimmers in their party.
  • Guests acknowledge that beach and ocean conditions can change rapidly — including rip currents, strong tides, marine wildlife, weather, and lightning — and agree to follow all posted flag warnings, beach patrol instructions, and Orange Beach municipal ordinances.
  • Children must be supervised at all times, especially around pools, hot tubs, beaches, balconies, and stairs.

Limitation of Liability

  • Beacon Escapes, its owners, employees, contractors, and property owners shall not be held liable for any injury, illness, drowning, near-drowning, loss, damage, or death suffered by Guests, visitors, or invitees, whether arising from intentional or unintentional acts, equipment malfunction, weather, natural disasters, acts of nature, or any other cause, except as required by law.
  • The Primary Guest agrees to indemnify and hold harmless Beacon Escapes and the property owner from any and all claims, lawsuits, damages, or expenses (including reasonable attorney’s fees) arising from the Guest’s stay or use of the Property and its amenities.
  • The maximum aggregate liability of Beacon Escapes under these Terms shall not exceed the total amount paid by the Guest for the reservation.

14. Children & Supervision

  • Children must be supervised at all times, particularly around pools, hot tubs, stairs, balconies, and beach areas.
  • Beacon Escapes does not provide childcare, lifeguards, or special equipment unless explicitly listed in the Property amenities.

15. Communications & Marketing Consent

By providing your email address or phone number, you consent to receive transactional communications related to your reservation (booking confirmations, check-in instructions, post-stay follow-ups, review requests). You may opt in or out of marketing communications separately. We will not share your contact information with third parties except as required to fulfill your reservation or comply with the law.


16. Dispute Resolution & Governing Law

  • These Terms are governed by the laws of the State of Alabama.
  • Any dispute arising from a reservation or stay shall be resolved exclusively in the courts of Baldwin County, Alabama.
  • The Primary Guest agrees to first attempt to resolve any dispute directly with Beacon Escapes in good faith before initiating legal action.
  • If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

17. Entire Agreement & Amendments

These Terms, together with the confirmed reservation and any written addenda, constitute the entire agreement between the parties. Any modifications must be in writing and signed (electronically or in ink) by both parties. Beacon Escapes reserves the right to update these Terms from time to time; the version in effect at the time of your reservation governs your stay.
